1. Booking Procedure

All charter booking requests must be submitted through the official AC38 charter booking website.

All reservations are subject to vessel availability, confirmation by Sail & Charter and acceptance by the relevant Official Supplier.

A booking shall only be considered confirmed once the required 50% deposit has been received and written confirmation has been issued.

Sail & Charter acts as the Official Charter Boat Partner, charter broker, booking intermediary and authorised collection agent on behalf of the relevant Official Supplier.

2. Payment Conditions

All payments must be made directly to Sail & Charter, acting as the authorised collection agent of the Official Supplier.

The following payment schedule applies:

  • 50% deposit upon booking confirmation.
  • 50% final balance no later than 30 calendar days before the scheduled charter date.

For bookings confirmed within 30 days of the charter date, full payment (100%) is required upon confirmation.

No vessel shall be released for charter unless the full amount due has been received before departure.

Failure to comply with the payment schedule may result in cancellation of the reservation, subject to the applicable cancellation conditions.

3. Invoicing and Tax Obligations

Sail & Charter may issue proforma payment requests for the initial 50% deposit and the remaining balance in its capacity as booking intermediary and authorised collection agent.

All charter payments collected by Sail & Charter are received on behalf of the relevant Official Supplier.

Following completion of the charter service, the Official Supplier responsible for operating the vessel shall issue the final fiscal invoice directly to the client, including the applicable VAT and in compliance with its own tax and invoicing obligations.

Any legally required advance-payment tax documentation shall be issued in accordance with applicable legislation.

4. Client Cancellation

Any cancellation requested by the client must be communicated in writing to Sail & Charter.

Unless otherwise expressly agreed in the booking confirmation or charter agreement, the following cancellation conditions shall apply:

  • More than 30 days before the charter date: the 50% booking deposit is non-refundable.
  • 30 days or less before the charter date: 100% of the confirmed charter price is non-refundable.

Any additional services contracted through third-party providers, including catering, hospitality, entertainment, transfers or special arrangements, shall remain subject to their respective cancellation policies.

5. Cancellation Due to Adverse Navigation Conditions

If the AC organisation officially suspends the regattas due to weather conditions preventing the competition from taking place and the departure from berth of the vessels chartered to follow the regattas, including strong winds, heavy rain, hail, thunderstorms, etc., the companies undertake to offer the client either an alternative day, amongst those selected as reserve days by AC itself, or reimbursement of 80% of the amount paid, subject always to the cancellation policies applicable to third-party contracted services such as food and beverage.

6. Cancellation of Regattas Due to Conditions Adverse to the Competition

If the AC organisation officially suspends the regattas due to lack of wind and/or conditions preventing the competition from taking place, but not preventing the departure of the vessels chartered to follow the same, the companies shall offer the client the alternative of still enjoying the event. If the client decides not to proceed with the event and does not board, the client shall be entitled to a 50% refund, subject always to the cancellation policies applicable to third-party contracted services such as food and beverage.

7. Cancellation of Regattas During Competition

Provided that the AC organisation officially suspends the regattas for any reason it deems appropriate and the vessels chartered to follow the regattas have already sailed, the companies shall offer the client the alternative of continuing to enjoy the event. If the clients wish to return to port, they shall not be entitled to any refund.

8. Operational and Navigational Conditions

All charter operations are subject to applicable maritime regulations, instructions issued by the relevant maritime authorities, official America's Cup operational procedures and the captain's professional judgement.

The captain retains full authority over navigational safety, vessel operation and the safety of all passengers and crew.

Access to designated Priority Boat areas is subject to official accreditation, applicable operational regulations and instructions issued by the event authorities.

Neither Sail & Charter nor the Official Supplier guarantees that the scheduled races will take place, that particular teams will be visible or that a specific position within the racecourse will be available.

9. Passenger Capacity and Safety

The maximum number of passengers permitted on board shall be strictly limited to the vessel's legally authorised passenger capacity.

All passengers must comply with the captain's safety instructions and applicable maritime regulations.

The operating Official Supplier and the vessel's captain shall be responsible for ensuring compliance with applicable maritime safety requirements.

10. Additional Services

Additional services, including catering, beverages, entertainment, branding, special equipment, transfers or other hospitality arrangements, must be requested and confirmed in advance.

Such services may be subject to separate quotations, advance payments and cancellation policies.

Any branding or promotional activity involving America's Cup trademarks, team identities or sponsor logos must comply with the applicable intellectual property and event branding regulations and obtain the necessary approvals.

11. Changes to Reservations

Requests to modify charter dates, vessels, passenger numbers or contracted services must be submitted in writing to Sail & Charter.

All changes are subject to availability, operational feasibility and any applicable price adjustments.

No modification shall be considered confirmed until written approval has been issued.

12. Responsibilities and Liability

Sail & Charter acts as the Official Charter Boat Partner, booking intermediary and authorised collection agent on behalf of the relevant Official Supplier.

The Official Supplier is responsible for the operation of the vessel, the delivery of the charter service and compliance with all applicable maritime safety and legal requirements.

Nothing in these Terms & Conditions shall exclude any liability that cannot legally be excluded under applicable law.

13. Acceptance of Terms
